2008 Oregon Legislative Assembly

The 2008 Oregon Legislative Assembly met in Special Session from February 4 through February 22.

Legislators approved House Bill 3605, which permits the director of the Department of Consumer and Business Services (DCBS) to modify insurance policy terms when the Governor declares a state of emergency. The DCBS director may issue an order that addresses any or all of the following matters related to insurance policies issued in Oregon:

  1. Reporting requirements for claims;
  2. Grace periods for payment of insurance premiums and performance of other duties by insureds; and
  3. Temporary postponement of cancellations and nonrenewals.

An order by the director may remain in effect not more than 30 days unless the director extends the termination date for an additional period of not more than 30 days or for subsequent additional periods of not more than 30 days.

HB 3605 was effective upon passage.

The director will adopt administrative rules establishing criteria for issuing orders.
